Berkeley Police officers arrested three men, including two felons, with a loaded firearm after finding one of them smoking marijuana in a stolen car at the Berkeley Marina earlier this month.

Police conducting a security check at the marina on Feb. 11 found Deangelo Porter, 25, sitting in the driver’s seat of an SUV parked at the marina smoking marijuana, according to court records.

Officers then conducted a narcotics investigation of the car, and found it to have been reported stolen from Hertz Rent a Car in Alameda.

Officers placed all three men in handcuffs, and searched the vehicle.

According to court papers, they found 12.7 grams of suspected marijuana, three “edible” marijuana packages and three bottles of promethazine codeine, with the labels ripped off, in the vehicle.

Under the front passenger seat, officers said they found a loaded 9mm firearm.

Police did a records check on Porter, and found him to have a 2007 felony conviction for robbery, and arrested him. According to the Alameda County district attorney’s office, that conviction was from the robbery of a transit operator in February of that year. A new conviction for him would count as a second strike.

Police also arrested 24-year-old passengers Devon Porter, who was on felony probation, and Auntario Sullen. Devon Porter’s felony was for carrying a concealed firearm in a vehicle in July 2012.

The Porters have been charged with felony possession of a firearm by a felon.

All three men were charged by the Alameda County district attorney’s office with carrying a concealed firearm in a vehicle; carrying a loaded firearm on one’s person in a city; possession of ammunition by a prohibited person; possession of a controlled substance in connection with the codeine; and transportation of marijuana. All of those charges are felonies.

Deangelo Porter posted a $195,000 bond, and no longer is in custody. Devon Porter remains in custody at Santa Rita Jail with a bail of $195,000.

Sullen is being held at Santa Rita with a bail of $100,000.

All three are scheduled for a pre-trial hearing Feb. 24 at the Wiley W. Manuel Courthouse, Department 115, in downtown Oakland.
